Terms and Conditions
This site can be used by residents of the UK only and prizes will only be sent to UK addresses.
These terms and conditions together with any specific rules set out in Competition Notices (as defined below) are the Competition Rules ("Rules") and apply to competitions included on the www.quidster.com website ("Competition"), unless otherwise expressly stated. By entering a Competition, entrants agree to be bound by these Rules.
Rules specific to each Competition are displayed in a notice included on the www.quidster.com web page posting for such Competition (the "Competition Notice") and are incorporated herein. In the event of discrepancy between these terms and conditions and the Competition Notice, the Competition Notice shall prevail.
Quidster.com reserves the right to cancel or amend the Competition, the Competition Notice or these Rules at any time without prior notice. Any changes will be posted either within the Competition Notice or these Rules.
In the event of any dispute regarding the Rules, Competition Notice, conduct, results and all other matters relating to a Competition, the decision of Quidster.com shall be final and no correspondence or discussion shall be entered into.
Qualifying Entrants
To qualify to enter the Competition you must be resident in the United Kingdom and of 16 years of age or over.
Employees or associates of Quidster.com or any company involved in the Competition or, if relevant, any promotions to which a Competition relates, or any advertising agency or web company connected with Quidster.com or any such person’s subsidiary or associated companies, agents or members of their families or households, are not eligible to enter the Competition. Quidster.com reserves the right to verify the eligibility of all entrants.
By registering with Quidster.com you agree to abide by these Terms & Conditions and you hereby warrant that all information submitted by you is true, current and complete.
By registering your contact details you are granting permission to receive periodic e-mails from Quidster.com regarding promotions, etc.
Quidster.com assumes that by using its site and entering a Competition (and you warrant that) either you have legal capacity to enter the Competition and agree to the Rules (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract).
Quidster.com reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these terms and conditions.
In the event that any entrant is disqualified from the Competition, Quidster.com in its sole discretion may decide whether a replacement contestant should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.
Entries made under User Names that are deemed offensive in any way to Quidster.com or other members/players will be deleted without entering into any further correspondence. Genuine players will be permitted to re-register with an alternative User Name and continue to play at Quidster.com's descretion. The organisers' decision is final.
Competition Entries
There is no limit to the number of online entries per person per Competition allowed, providing they have sufficient funds in their Quidster account to enter competitions in accordance with the normal entry procedures.
Competition entries must be made in the manner specified on the Competition Notice and/or How To Play Notice. Failure to do so will disqualify the entry.
Any attempts to submit macro-generated entries or entries falsified in any way will be disallowed and the user account will be suspended without any further correspondence being entered in to. No refund will be applicable on credits already spent where an entry/entries (falsely generated or otherwise) into a competition/s can be proven in the system log. In such cases, unspent credits will not be refunded and shall be contributed to the monitoring, security and possible legal costs incurred by the operator as a result of the dishonest actions of that user.
There is a requirement to register and set up funds in your Quidster account via Paypal in order to enter competitions on the Quidster.com website.
Quidster.com cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.
The typical maximum lifespan of a competition is 6 months (this may be increased at the discretion of Quidster.com) if the limited entry places have not all been taken during the normal course of play within a realistic timespan (no more than 12 months maximum). The pre-set closing date for any competition can be obtained by request, please state the competition ID number. In the event of a competition being closed prior to all limited entry places being taken, the prize listed shall be withdrawn. The Entrant with the fastest time recorded for submitting the correct answer will be awarded 20% of the monies taken for that specific competition (from its launch date to its closure date). This action shall conclude such a competition where there is failure to fill all entry spaces and no other correspondence shall be entered in to regarding such a matter.
All limited entry places must be filled for each competition for the specified prize to be awarded to the winner.
The number of entry places is relative to the value of the prize and other costs borne by the organisers. Quidster.com determine the number of entrants each competition is limited to and no other correspondence shall be entered in to regarding such a matter.
Under normal circumstances, a competition will end automatically when all limited entry places have been filled and the winner is identified.
Quidster Postal competition: Quidster.com has provided a competition for postal entrants (see link on the website homepage). A postal entrant cannot provide an online score/time or a leaderboard position in the same way that an online entry would achieve, therefore a winner will be selected at random by an independent judge on the specified closing date. Prizes
Prize winners will be automatically identified by the Quidster.com server as the entrants who submitted the correct answers in the fastest times recorded by the Quidster.com timer. If Quidster.com have reason to suspect an entry has been tampered or altered in any way, we reserve the right to retain the prize and suspend that entry until further investigations either deem the entry to be in accordance to our Terms & Conditions or otherwise. In all matters, the decision of Quidster.com shall be final and no correspondence or discussion shall be entered into.
Prize winners will be notified by e-mail and displayed on the Quidster.com website (Username and score) and usually within 24 hours of a competition ending. Return of any prize notification as undeliverable or failure to reply within 180 days therein may result in disqualification and selection of an alternate winner. If more than one prize is awarded only one prize per entrant will be awarded. Competition winners’ User names and county of residence may be published on the Quidster.com website.
Claims for prizes must be made in the manner and within the time specified on the Winners Notification E-Mail sent to the Winners by Quidster.com. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.
When making arrangements to verify an entry in order to release a prize, Quidster.com shall make reasonable attempts to contact the winner from the information supplied on their registration form. This includes e-mail correspondence to the e-mail address supplied on the registration form and calling the telephone number provided on the registration form. No attempt to send written correspondence to the postal address will be made before either of the above forms of contact between Quidster and the winner have been made first, so entrants should be aware that a valid and current e-mail address and telephone number must be supplied in order to verify their prize claim. When reasonable attempts to contact the winner (as described above) fail to make satisfactory contact, the win shall be deemed null and void if the winner does not attempt to make contact with Quidster.com within 28 days of the alleged win.
Prizes are non-transferable and there is no cash alternative. Quidster.com reserves the right to substitute prizes of equal or greater value at any time.
Wherever possible, Quidster.com displays accurate visual representations of the prize awards. In some cases, the prize may differ from the image displayed (eg. different colour, alternative brand, etc), therefore photos displayed are for guidence only and the written description of the prize takes presidence over the image(s) shown.
Prizes are awarded at Quidster.com’s discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant.
In normal circumstances, Quidster.com will arrange the delivery of the prize to the winner’s UK mainland address (as provided by them on their registration form) at no extra charge. If as prize is deemed to be too large, too heavy or too valuable to send by standard methods (eg. Royal Mail or recognised Courier Service) then the Winner/Entrant must be agreeable to collect their prize from a mainland UK address (eg. a specific car dealership within their region) as advised by Quidster.com following the release of the Winners Notification E-Mail. Any expenses incurred in making the collection of the prize are the total responsibility of the Entrant.
All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses, upgrades, etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner.
In some cases, the prize may be despatched directly from our suppliers to the winner. All prizes should be signed for as "unchecked" if the delivery driver is unable to wait whilst the contents are checked. In the event of a prize being damaged in transit and/or upon arrival, the recipient must inform Quidster.com within 48 hours of delivery.
Intellectual Property Rights
In consideration of Quidster.com agreeing to consider entrants to the Competition, each entrant hereby assigns to Quidster.com the complete copyright and all other rights in any entry, which shall be for the full period of copyright. Quidster.com shall be free to assign such rights to third parties.
Furthermore, any information submitted by you must be personal to and relate specifically to you. You hereby warrant that the information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, Quidster.com reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.
Liability
Quidster.com cannot accept any responsibility for any costs, damage, loss, injury or disappointment suffered by any entrant entering the competition or as a result of accepting any prize. Quidster.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude Quidster.com’s liability for death or personal injury as a result of its negligence.
Data Protection and Publicity
Winners may be requested to take part in promotional activity and Quidster.com reserves the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity.
Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual’s prior consent.
Jurisdiction
The Competitions and the terms and conditions of this agreement will be governed by English law.
